Welcome to the Sit App provided by Stitch In Time Technologies (referred to as "Stitch In Time," “Sit App” "we," "us," or "our"). This Privacy Policy outlines how we collect, use, share, and protect your personal information when you use the Sit App available on the Apple App Store and Google Play Store (the " Sit App").

For the purposes of this policy, a ‘User’ will constitute a Parent and/or a Carer.

PLEASE READ THIS PRIVACY NOTICE CAREFULLY.

If you live in certain countries, additional terms may apply to you and can be found at the end of this Privacy Policy (the "Additional Terms"). These Additional Terms override the other terms of this Privacy Policy to the extent of any inconsistency.

We are committed to protecting your privacy as a user (referred to as "User", "you" or "your"), and we take our responsibility regarding the security of your Personal Data (defined below) very seriously. We will be clear and transparent about the Personal Data we are collecting and what we will do with that Personal Data.

  1. Information We Collect

    1. Personal Information: We collect information you provide directly to us when you register an account with the Sit App. This includes your name, email address, and other optional details. If you update or add new details from time to time, we will collect this information also as you have provided it directly to us. 

    2. Child Schedule Data: The Sit App allows parents to create schedules and share them with chosen carers. This includes information related to child activities, appointments, and other scheduling details. Any data you enter during your use of Sit App about your child’s schedule will be collected. 

    3. Communication Data: When using the messaging feature within the Sit App, we collect the content of your communications, including text, images, and other media shared between you and your chosen carer.

    4. Usage Information: We collect information about your interactions with the App, such as the features you use, the pages you visit, and the actions you take within the App.

 

  1. Use of Information

    1. Providing Services: We use the collected information to provide the services offered by the Sit App, including creating schedules, facilitating communication between parents and carers, and delivering requested information.

    2. Communication: Your email address may be used to send you updates, newsletters, marketing communications, and offers related to the Sit App. You can opt-out of these communications at any time by following the unsubscribe instructions included in these emails.

    3. Improvement of Services: We analyze user interactions and behavior within the App to improve and personalize the user experience, develop new features, and enhance the functionality of the Sit App. 

    4. Administrative or legal purposes: We use your personal data to operate our business, including for statistical and marketing analysis, systems testing and to diagnose technical and service problems, maintenance and development of the Sit App, or in order to deal with a dispute or claim. We may also perform data analysis based on the data we collect from you for statistical and marketing analysis purposes. 

    5. Security, health, administrative, crime prevention/detection and legal purposes: We may use your Personal Data to verify your information and identity, and to protect against, identify and prevent fraud and other unlawful activities. We may also share your Personal Data with government authorities or enforcement bodies for compliance with legal requirements, or as otherwise required or permitted by applicable Data Privacy Law.

 

2. Sharing of Information

 

  1. With Carers: Information shared within the App, such as schedules and messages, is shared between the parent and the chosen carer. 

  2. Withdrawal of Information Sharing with Carers: If you no longer wish for a Carer to have access to information and/or media shared between the parent and a specific Carer, it is the Parents’ obligations to withdraw access to their account and any of the Child’s schedules, information or otherwise. 

  3. Third Parties: We do not sell, trade, or transfer your personal information to third parties for marketing or advertising purposes. However, we may share information with service providers who assist us in operating the App and providing services. These service providers are bound by confidentiality obligations and are only permitted to use the information for the purposes of providing services to us.

  4. Encryption and security: We follow strict security procedures in the storage and disclosure of your Personal Data, which are designed to protect it against misuse, unauthorised access, modification or disclosure and accidental loss, destruction or damage.

  5. International transfers of your Personal Data: the Sit App operates businesses in multiple jurisdictions. The personal data that the Sit App collects from users will be stored in Australia and might also be shared with third party data recipients (e.g., e-commerce and logistics providers such as Shopify, and customer support providers such as Zendesk) that may be located in various countries. Therefore, the Personal Data that you provide to the Sit App may be transferred internationally to countries other than the country in which you initially provided your data.

  1. Data Retention

    1. We will not retain your data for longer than is necessary to fulfill the purposes for which it is being processed. To determine the appropriate retention period, we consider the amount, nature and sensitivity of the personal data, the purposes for which we process it, and whether we can achieve those purposes through other means.

    2. We also consider the periods for which we might need to retain personal data in order to meet our legal obligations, or to deal with complaints and queries, and to protect our legal rights in the event of a claim being made.

    3. In general, this means that we will likely keep your personal data for as long as your User Account is open. Following closure of your User Account, however, we may still retain a limited portion of your Personal Data so that we can maintain a continuous relationship with you if and when we are in contact with you again, and to comply with our internal processes and any legal obligations.

    4. When we no longer need your personal data, we will securely delete or destroy it. We will also consider if and how we can minimise over time the personal data that we use, and if we can fully anonymise your personal data so that it can no longer be associated with you or identify you, in which case we may use that information without further notice to you.

    5. Messages and Media: Messages and media (including photos, videos or otherwise) shared within the App are stored temporarily and automatically deleted every 30 days for privacy and security reasons.

    6. Your Personal Data: Your personal data and any information entered into the Sit App throughout your use of the App will be retained on an ongoing basis. Upon cancelling your subscription/membership and deleting your account, Sit App may retain data for the purposes of service improvement and as otherwise required by Sit App, however that data will be non-specific and deidentified. 

 

Security

We implement reasonable security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. Each user is also expected to take reasonable measures to protect their information, including any passwords or other identifying details which it includes in the use of the Sit App. 

  1. Children's Privacy

The Sit App is intended for use by individuals of all ages. However, if a user is under the age of 16, a parent or legal guardian must provide consent for the collection of personal information. In accordance with the Terms and Conditions, the user represents that it has specific parental consent to do so, and Sit App relies on this representation.  

  1. Compliance with Australian Privacy Laws

We are committed to complying with Australia's privacy laws, including but not limited to the Privacy Act 1988. This legislation outlines principles for the fair handling of personal information, including its collection, use, disclosure, quality, and security to which the Sit App intends to adhere.

  1. Transparency

 

  1. Depending on your global location and any local laws, you may have the right to request information about whether we hold Personal Data about you, and, if so, what that information is and why we are holding/using it.

  2. Access: You may request access to your Personal Data (commonly known as a "data subject access request"). This enables you to receive a copy of the Personal Data we hold about you and to check that we are lawfully processing it.

  3. Correction: You have the right to request correction of the Personal Data that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.

  4. Erasure: You can request erasure of your Personal Data. This enables you to ask us to delete or remove Personal Data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Data where you have exercised your right to object to processing.

  5. Object: You may object to processing of your Personal Data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation that makes you want to object to processing on this ground. You also have the right to object where we are processing your Personal Data for direct marketing purpose.

  6. Restriction of Processing: You have the right to request the restriction of processing of your Personal Data. This enables you to ask us to suspend the processing of Personal Data about you, for example if you want us to establish its accuracy or the reason for processing it.

 

  1. Updates to Privacy Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page, and we encourage you to review this Privacy Policy periodically throughout use of the Sit App or in any instance where you return to Sit App following a period of non-use of the app.

  1. Local Privacy Laws 

If the User is operating the Sit App in a country outside the country of origin (Australia), then the Privacy Policy herein is deemed to comply with and otherwise incorporate any specific privacy policy legislation that is applicable to the nature and use of the Sit App and the personal data collected by us. The Sit App otherwise refers to Clause 13.2 herein should any of the Privacy Policy be deemed unenforceable by means of local applicable laws in the Country of the User. 

  1. Indemnification

 

  1. To the maximum extended permitted by Applicable Laws, you agree to indemnify and hold harmless immediately upon demand Sit App and Stitch In Time Technologies, its officers, directors, employees, and affiliates and the Associated Parties from any claim, demand, lawsuit, action, proceeding, investigation, liability , damage, loss, cost or expense including reasonable attorney’s fees, in any way arising out of, in relation to or in connection with directly or indirectly:

  1. your use of, or conduct in connection with the Sit App;

  2. your breach of these Terms or any other policy;

  3. the Contributed Content you provide; and/or

  4. your violation of any Applicable Laws or the rights of any other person or entity. 

  1. You will provide the Sit App and any associated parties with any assistance that the Sit App and the associated parties reasonably request in defending any such action or proceeding. 

 

  1. Limited Liability 

 

  1. No Consequential Damages: In no event shall Stitch In Time Technologies, its officers, directors, employees, or affiliates be liable for any consequential, incidental, indirect, special, or punitive damages, or any loss of profits or revenues.

  2. Users of the Sit App further agree and accept that the liability of Stitch in Time Technologies does not extend to the conduct of its users, or any instances that occur in relation to the use of the App which arise whilst a Carer is in operation.  

 

  1. Severability and Entire Agreement

 

  1. Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

  2. Entire Agreement: These Terms constitute the entire agreement between you and Stitch In Time Technologies regarding the Sit App, superseding any prior agreements.
